Study on the Theory Frame of "Tri-Party Engineering Contract"

The concept of contract in the law of contract bases on the two-party contract relationship and most of construction contracts are two-party contracts. Because of this status, the workers undertaking engineering contract management gets used to two-party contract and people tends to understand gradually springing up tri-party contract. This way easily causes tri-party contract misunderstood. This paper plans to analyze the tri-party contract systematically and put forward concept, types and characters of the tri-party contract. And it lists the problems needed to be dealt with in the further study of tri-party contract.
