Wisdom is the exclusive nature of human consciousness and one of the signs of human beings. In addition to the Internet+, big data and artificial intelligence which are computer technology as the physical basis, it's cognitive basis, operation mode and purpose effect involved in Intelligent Justice are all based on the premise and reference of cognitive science. Therefore, the Intelligent Justice based on data and algorithms is an imitation of some human functions, which ultimately is mainly to provide services for human beings. In view of this, explaining the cognitive basis of Intelligent Justice is of great theoretical significance for understanding the construction of Intelligent Justice. Starting from the development of cognitive science, it can be further discussed for Intelligent Justice which simulates human cognitive mode regarding IT as the core, and the limitations and transcendence compared with human cognition can be clarified.
