Standardizing protection for property rights in information and information technology: a law and economics perspective

Property rights in information and information technology are protected against legislative and regulatory "takings" under American law by disparate constitutional standards. This arrangement is arbitrary, and it has adverse consequences for innovation and other aspects of economic efficiency. Standardizing property rights protection for both information and information technology along the lines of First Amendment doctrine would be widely beneficial.
