A study of the innovation and protection mechanisms for the cultural and creative industries

The vital status and uniqueness of the cultural and creative industries means that intellectual property protection is of paramount importance to these industries, whose very survival depends upon creativity and intellectual property. Intellectual property protection is the foundation of the growth and development of these industries. At present, the main challenges to intellectual property protection in China's cultural and creative industries are the weak awareness of the importance of intellectual property protection and the unscientific path choice for intellectual property protection. As such, it's critical to provide comprehensive protection for the cultural and creative industries with an integrated intellectual property protection system that covers patent rights, trademark rights, commercial secret rights, and anti-unfair competition legislation. The implementation of the mechanisms for the cultural and creative industries depends on the initiatives adopted by the different actors in the cultural and creative industries, such as the government, industry associations, intermediary organizations and creative enterprises, on the basis of their respective positions in the development of these industries. Thus, it's imperative to enhance the driving force of “creativity”, strengthen property protection and capital operation, and build “cultural creativity + science and technology + finance” channels for industry realization.
