Research on Normalization of Fire Liability Accident Case Investigation

Revision of the Criminal Procedure Law proposed higher requirement for normalization of the public security's law enforcement. How to adapt to the new requirements is a new question for the public fire agent which responsible for investigating the fire liability accident case. Based on the spirit of the Criminal Procedure Law's revision, combined with experience of fire liability accident case investigation, some questions existing in the fire liability accident case investigation were studied. For example, the application of graded jurisdiction prescribed too principle, direct economic losses was determined casually, investigation subject was illegal, custody was extended and evidence was illegal collected, the criminal suspect's defense right didn't guaranteed, evidence keeping was chaos, file making wasn't standard etc. Aimed at problems, some suggestions were put forward as following: First, clear applicable conditions of grade Jurisdiction, Second, pay attention to direct economic losses statistics, Third, standardize qualification of investigation subject, Forth, strengthen law enforcement supervision and fundamental construction, Fifth, establish defense system in investigation procedure, Sixth, reinforce responsibility system of evidence preservation and file management. These Suggestions will help for the fire agent to implement spirit of the Criminal Procedure Law's revision, promoting normalization's degree of the fire liability accident case investigation.
