AI and Intellectual Property Law: Challenges and Opportunities in Digital Age

The rapid advancement of artificial intelligence (AI) is reshaping the landscape of intellectual property (IP) law, presenting both significant challenges and opportunities. As AI systems increasingly generate creative works and innovations autonomously, traditional IP frameworks— historically centred around human creators and inventors— are being tested. This paper explores the impact of AI on IP law, focusing on authorship and ownership issues, the patentability of AI-generated inventions, and the role of AI in enhancing IP management and protection. Utilizing a qualitative methodology that combines doctrinal legal research and semi-structured interviews, the study identifies key legal ambiguities and gaps, highlights expert consensus on the need for regulatory adaptation, and examines the potential for AI to improve IP management through advanced analytics and automation. Findings underscore the necessity for evolving legal frameworks to address the unique challenges posed by AI while fostering innovation and ensuring fair protection of IP rights.
