A novel method to obtain adaptive background from dynamic scene is proposed in the paper. Through computing the difference between neighbouring frames, the states of pixels were attained. The values of marking matrix are modified according to relative moving states and punished by different position. When the value of matrix's element is equal to zero, the pixel in corresponding position belongs to background. Pixel is moving only when it is in moving state through computing the difference of neighborhood frames and difference between current frame and background frame. It also gives relating parameters, which have relation to occasion for image capture. Experiments show that the results of detecting and capturing the moving objects are ideal. And it can exclude disturbance of pedestrians and moving vehicles in adjacent lanes
